The Fix Was In: Ousted NLRB Member Offered NLRB General Counsel Job One Day After Senate Deal

The Tuesday Senate deal cut by Republicans and Democrats on Tuesday to avoid the “nuclear option” just keeps getting better and better…for union bosses.

You may recall that on Tuesday, the only “victory” that Republicans could lay claim to in exchange for their giving Harry Reid nearly everything Democrats wanted was that two of Barack Obama’s constitutionally-challenged “recess” appointments to the National Labor Relations Board would be let go.

Well as it turns out, while Operating Engineers’ chief counsel Richard Griffin is being tossed from his seat on the National Labor Relations Board, he is now being offered the position of the NLRB’s General Counsel.

More importantly, it appears that Democrats (if not Republicans, as well) knew that Griffin would be nominated for the General Counsel job.

After losing his nomination to the National Labor Relations Board this week as part of the Senate filibuster deal, Richard Griffin is expected to be offered the high-profile position of general counsel to the labor board, according to sources familiar with the matter.

Griffin’s nomination to general counsel, which serves as a kind of prosecutor at the board, would place him in one of the most critical roles at the agency. The position requires the kind of Senate confirmation that previously eluded Griffin, but his new nomination is not expected to be as controversial. Republicans generally had not disputed his qualifications to serve, only his recess appointment, which the U.S. Court of Appeals for the D.C. Circuit ruled unconstitutional in a case to be taken up by the Supreme Court.

Asked on Tuesday after a meeting of the caucus if Democrats had found jobs for the dispatched nominees, Harkin said yes, but declined to give details. “I don’t know that I’m free to talk about that right now, but yes, everything is working out,” he said. [Emphasis added.]

Given the fact that Republicans still can have the “nuclear option” threat used against them anytime they get out of line, it now appears they didn’t accomplish anything of substance with Tuesday’s Senate deal.

    Unbelieveable, but with our ongoing degeneration, to borrow from Niall Ferguson, it is sadly not surprising. The NLRB is now, clearly, a No Longer Respected Board. If new evidence was even needed, this latest development confirms, once again, that the Legislative and Executive branches are corrupt – vote the way the money demands. Labor elects by funding Democrats who do as told; business elects by funding Republicans who do as told. Cede or secede?
