EXCLUSIVE: Bernie Sanders’ Campaign Faces Charges Of Unfair Labor Practices


Federal charges for multiple labor law violations were filed against Bernie Sanders’ campaign with the National Labor Relations Board on Monday.

As was noted here yesterday, based on press accounts, it appears as though Bernie Sanders’ campaign may be violating the law in certain areas.

Well, yesterday afternoon, there was a federal charge filed against the Sanders campaign with the National Labor Relations Board office in Iowa for multiple alleged violations of the law.

Although filed as a single charge, the accusations consist of:

  • Interrogation (including Polling)
  • Concerted Activities (Retaliation, Discharge, Discipline)
  • Discipline
  • Discharge (Including Layoff and Refusal to Hire (not salting)
  • Repudiation/Modification of Contract [Sec 8(d)/Unilateral Changes]

While the specifics of the charges will not be revealed until the NLRB conducts an investigation, the accusations against the socialist Senator come at a time when he is facing greater public scrutiny and accusations of ‘hypocrisy‘ over his pay practices.

Additionally, the charging party is an unnamed individual–presumably a current or former campaign staffer–and not the union representing the campaign’s staff.

In yesterday’s post, it was noted that, given Sanders’ own statements to the press that “it was ‘really not acceptable’ and that it was ‘improper’ that ‘people are going out outside the process and going to the media,’ Sanders’ statements could be construed as threats against employees for exercising their rights, as “prohibiting employees against talking to the press about their wages or working conditions could be found unlawful.”

It is unclear whether the charges are related to Sanders comments.

The NLRB, according to the agency’s website, has assigned the case to its office in Indianapolis.
