There is a fundamental question that is often overlooked, yet is at the core of the issue, when people debate so-called Right-to-Work laws and that is:

  • Do you think a union should be able to have unionized workers fired from their jobs for not paying union dues?

  1. I’m a management side labor lawyer who believes that this is essentially a political quesetion. This provision has been on the books since the Taft-Hartley Act. If the citizens in certain states wish to enact Right to Work Laws, they can do so. (And voters in a couple of states have done just that in recent years, as we know). I fully support Right to Work laws as a political matter. But, in states that have not enacted right to work law, it’s obviously currently legal to enforce union security provisions in collective bargainnig agreements. I think we should leave things right where they are.
